Terms of Service

Your Listing is an Australian business. In these terms "we", "us" and "our" mean Your Listing, and "you" means the agency, business or person using Your Listing.

By creating an account, or by using Your Listing on behalf of an agency that has one, you agree to these terms. If you are agreeing on behalf of a business, you confirm you have the authority to do so.

An agency has one workspace. The person who creates it is its owner and can invite other members, remove them, and manage billing. Every member is responsible for what they do while signed in.

Keep your sign-in details to yourself. Tell us straight away if you think someone else has used your account. You must be at least 18 to hold an account, and the details you give us must be accurate and kept up to date.

Your Listing lets you build and publish property listings with interactive floor plans, photos, maps and buyer tools, and share them as pages, embeds and links. Some features, such as buyer shortlists, enquiries, reports and AI-assisted tools, may change over time as we improve the product.

We will give reasonable notice of changes that materially reduce what the service does. We may add features, and adjust or retire minor ones, without notice.

Publishing a listing, and some other actions we identify in the product, uses credits. Credits are bought in packs through our payment provider, Stripe. Prices are shown in Australian dollars and include GST where it applies.

Credits never expire. They stay in your workspace for as long as it exists, and members of the workspace can spend them.

Credits are not refundable once purchased, except where the Australian Consumer Law or another law requires a refund. Our Refund Policy explains how this works and what happens if something goes wrong on our side.

We may change the price of credit packs, and the number of credits an action uses, for future purchases. A change never takes credits you already hold.

You own the listings you build: the photos, floor plans, descriptions and other material you upload. You give us a licence to store, process and display that material so we can provide the service, including on the public pages and embeds you choose to publish.

You are responsible for having the right to use everything you upload, including photographs and floor plans supplied by third parties, and for making sure your listings are accurate and comply with the laws that apply to advertising property in your state or territory.

You must not upload material that is unlawful, misleading, defamatory, or that infringes anyone's rights. We may remove content that breaks these terms.

People who view your listings may save them, send enquiries and, where you enable it, leave private notes. You will receive engagement signals and any enquiries addressed to you. Private notes a buyer keeps for themselves are never shown to you.

Information you receive about buyers and renters through the service is personal information. You must handle it in line with the Privacy Act 1988 (Cth) and use it only for the purpose it was given to you: the enquiry about that property.

If you are looking at a listing, a shortlist or a report that an agency has published with Your Listing, these terms apply to you as a visitor, and this section is the part that matters most.

The information on a listing is supplied by the agency that published it, not by us. We do not check it. Prices, sizes, floor plans, availability and descriptions can be wrong or out of date, and nothing on a listing is advice about buying, renting or investing. Make your own enquiries before you rely on it, and take up anything about a property with the agent named on the page.

You can save listings, keep notes, share a shortlist and send enquiries. The notes you keep are private to you. An enquiry goes to the agency for that property, along with the details you choose to include, and how they respond is between you and them.

You must not use the listings, images or floor plans for anything other than considering the property for yourself or someone you are helping.

Whether you are an agency or a visitor, you must not:

(a) use any automated tool, script or service to access, copy, scrape or index the service or the content on it; (b) collect listings, images, floor plans or contact details to build a database, a comparison product or a property data product; (c) place an unreasonable load on the service or interfere with how it works or how it is secured; (d) try to reverse engineer, copy or replicate the service or how its interactive floor plans and builder work; (e) resell or sublicense the service, or let anyone outside your agency use your workspace; (f) pretend to be another person or agency, or try to get sign-in details or personal information from anyone; (g) send spam, mass messages or unlawful material through the service; or (h) do anything that breaks these terms or the law.

Use that we reasonably believe harms other users or the service may be limited or suspended without notice.

Listings can include maps, address search, video, booking links and links to an agency's own website. Those services and sites belong to other companies. We do not control them, we are not responsible for what is on them, and their own terms and privacy policies apply when you use them.

A link on the service is not an endorsement of the site it points to.

The technology behind Your Listing, including its interactive floor plan and builder systems, is owned by Odyssey and licensed to Your Listing. It is protected by copyright, trade mark and patent law, and patents are pending. Our IP Notice sets this out in full.

Nothing in these terms gives you any ownership of the service or its technology. You receive only the right to use it in line with these terms.

We aim to keep the service available at all times, but we cannot promise it will never be interrupted. Maintenance, outages at our providers and events outside our control can affect it. We will do what we reasonably can to restore service quickly.

You should keep your own copies of the photos, floor plans and material you upload.

You can close your workspace at any time. Published pages will stop working and your content will be deleted after a reasonable period. Unused credits are forfeited when a workspace is closed, so spend them first.

We may suspend or close an account that breaks these terms, or where we are required to by law. Where it is reasonable to do so we will warn you first and give you a chance to fix the problem.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

To the extent the law allows, Your Listing is not liable for indirect or consequential loss, loss of profit, or loss of data, and our total liability to you for anything arising from the service in any 12-month period is limited to the amount you paid us in that period.

You agree to cover us for claims made by third parties that arise from content you upload or from your use of the service in breach of these terms.

These terms are governed by the laws of New South Wales, Australia, and the courts there. If any part of these terms cannot be enforced, the rest still applies.

We may update these terms. If we make a material change we will tell you in the product or by email before it takes effect. Continuing to use Your Listing after that means you accept the updated terms.
